What is the purpose?
Currently the environmental site assessment standard is ASTM 1527-00,
however, Congress has instructed the U.S. EPA to issue regulations
defining what constitutes “All Appropriate Inquiry,” as it relates
to assessing environmental conditions of a property prior to its
acquisition. This ruling will be the first of its kind and will
enable innocent purchasers, bona fide prospective purchasers and
contiguous property owners to establish a defense to Superfund
liability.
